Statement of the Center for Public Justice on the Passage of the Pregnant Workers Fairness Act

Pregnant Workers Gain Strong Legal Protections


(December 23, 2022) — The Center for Public Justice applauds Congress for passage of the Pregnant Workers Fairness Act (PWFA). The PWFA will protect the health of millions of pregnant women and their children, making it easier to secure accommodations such as a place to sit or appropriate breaks while at work.

The legislation also explicitly confirms protections for religious employers. As such, it represents the kind of common-ground effort so important in our polarized political community.

The Supreme Court’s recent decision in Dobbs v. Jackson Women’s Health Organization has prompted major shifts in the laws regulating pregnancy and abortion in the United States. According to Rachel Anderson, Fellow with CPJ’s Families Valued program, “it’s crucial that policy-makers and citizens, including those who hold differing views about the moral or legal status of abortion, find ways to work together to promote the flourishing of women, children, and families. Advancing protections for pregnant women in the workforce is an important step.” 

In the spirit of today’s action on behalf of pregnant women, we encourage members of Congress to continue to work together on other measures such as paid family leave, a topic around which CPJ has offered common ground principles. The Center for Public Justice congratulates Congress for their leadership on the PWFA and looks forward to working with policy-makers in the new year to promote policies that support and protect family life.
